Please read these terms carefully before using ConstructionGoPro.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ConstructionGoPro ("Company," "we," "us," or "our"), governing your access to and use of the ConstructionGoPro web application, including all related tools, features, and content (collectively, the "Service") available at constructiongopro.com.
By creating an account, accessing, or using the Service in any way, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to be bound by them. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms. If you accept these Terms for a business entity, "you" and "your" mean both you and that entity, and both are jointly and severally responsible for compliance with these Terms.
ConstructionGoPro is a web-based construction material estimating platform designed to help contractors, builders, and related professionals generate material takeoffs, cost estimates, and project summaries. The Service includes:
The Service is provided as-is for estimating purposes only. All estimates generated by the Service are approximations and should be verified by qualified professionals prior to ordering materials or commencing construction. ConstructionGoPro does not provide engineering, architectural, structural, or other licensed professional advice. The Service is a calculation aid and does not replace the independent judgment of a qualified professional.
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
We are not liable for any loss or damage arising from your failure to maintain the security of your account.
You may close your account at any time by contacting us at support@constructiongopro.com. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period. ConstructionGoPro may act without prior notice when the ground is a violation of these Terms or fraudulent activity. For suspension or termination based on inactivity or for convenience, ConstructionGoPro will give you advance notice by email and a reasonable chance to export your project data before it is deleted.
The Service is offered on a subscription basis. We offer the following subscription tiers (subject to change):

All payments are processed securely through Stripe, Inc. By providing payment information, you authorize us to charge your payment method for the applicable subscription fees. We do not store your complete payment card information on our servers.
Subscriptions are billed in advance on a recurring basis for the billing period you select, either monthly or annually. Your subscription automatically renews for another period of the same length at the end of each period. ConstructionGoPro charges your payment method the then-current subscription fee at each renewal until you cancel. You may cancel at any time from your account settings or by emailing support@constructiongopro.com. Cancellation takes effect at the end of the current billing period, and you keep access until then. ConstructionGoPro does not provide partial-period refunds unless required by law.
We reserve the right to modify subscription pricing with at least 30 days' advance notice sent by email. A price change takes effect only at your next renewal. If you do not accept the new price, you may cancel before the change takes effect, and continued use after that date confirms your acceptance of the new pricing.
Subscription fees are generally non-refundable. However, we may issue refunds at our sole discretion in cases of billing errors or exceptional circumstances. Please contact support@constructiongopro.com for refund inquiries. This refund policy does not limit any cancellation or refund right you have under applicable law that cannot be waived.
If a payment fails, we will notify you and may suspend access to paid features until payment is resolved. We reserve the right to terminate accounts with persistent failed payments.
Lumber dealers, building supply companies, and other material suppliers ("Dealers") may apply for a Dealer Account to display their pricing within the ConstructionGoPro platform. Dealer accounts are subject to a separate agreement and approval process.
Dealers are solely responsible for the accuracy of pricing information they provide through the platform. ConstructionGoPro makes no representations or warranties regarding the accuracy, completeness, or availability of Dealer pricing.
Dealer pricing is provided by third parties for your convenience. ConstructionGoPro does not set, verify, or guarantee Dealer pricing and is not a party to any purchase you make from a Dealer. Any purchase, quote, or dealing between you and a Dealer is solely between you and that Dealer. You release ConstructionGoPro from any claim, loss, or damage arising out of Dealer pricing or your dealings with a Dealer.

Dealers grant ConstructionGoPro a non-exclusive license to display their pricing information to Service users for the purpose of generating material estimates. Dealers retain ownership of their pricing data.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
ConstructionGoPro may investigate any suspected violation of this section, remove or disable content, and suspend or terminate access without prior notice. ConstructionGoPro may also disclose information as needed to comply with law or a lawful request, or to protect its users, partners, or the Service.
The Service, including all software, algorithms, design, text, graphics, logos, and other content, is owned by ConstructionGoPro and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or service marks.
You retain ownership of all project data, estimates, and other content you create through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you. You represent that you own or have all rights needed to upload your User Content, including any plans, drawings, or specifications, and that your User Content does not infringe the rights of any third party. You agree that ConstructionGoPro may process your User Content through its service providers and AI tools solely to operate and provide the Service. ConstructionGoPro will not use the content of your uploaded plans to train generalized AI models for other customers without your consent.
If you submit feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose, including improving the Service, without any obligation to compensate you.
ConstructionGoPro respects intellectual property rights and responds to notices of alleged copyright infringement. If you believe content on the Service infringes your copyright, send a written notice with the information required under the Digital Millennium Copyright Act to ConstructionGoPro at support@constructiongopro.com. ConstructionGoPro may remove content claimed to be infringing and may terminate the accounts of repeat infringers.
The AI plan reading feature is provided as a convenience tool and may not accurately extract all specifications from uploaded documents. Users are responsible for reviewing and confirming all AI-extracted data before relying on it for any purpose.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSTRUCTIONGOPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless ConstructionGoPro and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of another party. ConstructionGoPro will give you prompt notice of any claim subject to this indemnity, may participate in the defense with its own counsel, and will not settle a claim in a way that imposes an obligation on you without your consent. This indemnity does not apply to the extent a claim arises from ConstructionGoPro's own gross negligence or willful misconduct.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
ConstructionGoPro may modify, suspend, or discontinue any part of the Service at any time. ConstructionGoPro may also update these Terms. For material changes to these Terms, ConstructionGoPro will give you at least 30 days' advance notice by email or through the Service before the changes take effect. Changes apply going forward only. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and cancel your subscription before the effective date.
Either party may terminate these Terms at any time. Upon termination: (a) your right to access and use the Service will immediately cease; (b) we may delete your account and User Content in accordance with our data retention policies; and (c) all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. For 30 days after termination, you may ask ConstructionGoPro to provide an export of your User Content before it is deleted.
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Marathon County, Wisconsin, and you consent to personal jurisdiction in such courts.
BEFORE INITIATING ANY LEGAL ACTION, BOTH PARTIES AGREE TO ATTEMPT TO RESOLVE DISPUTES INFORMALLY BY CONTACTING THE OTHER PARTY IN WRITING AND ALLOWING 30 DAYS TO RESPOND AND ATTEMPT RESOLUTION.
To the extent permitted by law, any dispute will be resolved on an individual basis. You and ConstructionGoPro waive any right to bring or take part in a class action, collective action, or representative action arising out of these Terms or the Service. You and ConstructionGoPro also waive any right to a jury trial.
Any claim arising out of or relating to the Service or these Terms must be brought within one year after the claim arose, or it is permanently barred, unless applicable law does not allow this limit.
